North Carolina Landowner Appeals Initial Loss in Wetlands Suit

North Carolina landowner Robert D. White is challenging a judge’s denial of a preliminary injunction against the Biden administration’s wetlands rule that was a response to the Supreme Court’s ruling in Sackett v. EPA.

Judge Terrence Boyle of the U.S. District Court for the Eastern District of North Carolina on June 18 denied White’s motion seeking to block the rule defining waters of the U.S., or WOTUS, which was finalized in 2023.
