DC Circuit Denies Chinese Investors’ Request for Green Card Action

Chinese immigrant investors have failed in their attempt to force the federal government to grant their green card applications under a recent law that reserves permanent residency visas for certain investors.

The U.S. Court of Appeals for the District of Columbia Circuit agreed with a lower court, finding that the investors’ challenge to U.S. Citizenship and Immigration Services policy on EB-5 visa issues was premature because the USCIS statements and manual they targeted contained “no final agency action.”
